If you believe that content made available through Fluxer infringes your copyright or other intellectual property rights, you may notify us by using the report form at https://web.fluxer.app/report and selecting the relevant copyright or intellectual property option, or by emailing [email protected].
We review complaints in accordance with applicable law, including, where applicable, European Union law.
1. How to submit a complaint
To help us review your complaint promptly and fairly, please include the following information:
a description of the copyrighted work or other intellectual property right you believe has been infringed;
the exact location of the material on Fluxer, including any relevant message links, channel IDs, user IDs, or other information that will allow us to identify the content;
an explanation of why you believe the material infringes your rights or is otherwise unlawful;
your full name and email address, and any additional contact details you wish to provide;
a statement confirming that you have a good-faith belief that the use of the material is not authorised by the rights holder, its agent, or the law;
a statement confirming that the information in your complaint is accurate and complete and, where applicable, that you are the rights holder or are authorised to act on the rights holder’s behalf; and
your physical or electronic signature.
If your complaint does not include sufficient information for us to identify the content or assess the claim, we may be unable to process it.
2. How we review complaints
Fluxer reviews copyright and intellectual property complaints in a timely, diligent, non-arbitrary and objective manner.
Where a complaint contains sufficient information, we may take one or more of the following steps where appropriate:
remove the content;
disable access to the content;
limit the visibility of the content;
suspend relevant account features; or
suspend or terminate the account of the user responsible for the content.
Where required by applicable law, we will inform the affected user of the action taken and provide a statement of reasons.
Where you have provided contact details, we may also notify you of the outcome of your complaint, subject to legal, privacy, security, and confidentiality considerations.
3. Appeals and complaints about decisions
If you believe that your content was removed or restricted in error, or that action was taken on the basis of mistake or misidentification, you may challenge that decision.
Any appeal should include:
identification of the content affected and, where possible, its location before removal or restriction;
an explanation of why you believe the decision was incorrect;
your full name and email address; and
your physical or electronic signature.
Fluxer will review appeals in a timely, diligent, non-discriminatory and non-arbitrary manner. Where required by law, appeals will be subject to appropriate human review and will not be determined solely by automated means.
Where applicable, users may also have rights to further redress under relevant law, including the right to pursue the matter through courts or other available dispute resolution mechanisms.
4. Misuse of the reporting process
You must not knowingly submit false, misleading, malicious, abusive, or duplicative complaints.
You must not ask others to submit duplicate reports regarding the same content where a complaint has already been made on your behalf.
Misuse of Fluxer’s reporting or complaints procedures may result in rejection of the report and may lead to action against the relevant account, including suspension where appropriate.
5. Repeat infringement
Fluxer may suspend or terminate the accounts of users who repeatedly infringe copyright or other intellectual property rights.
When deciding whether to take such action, we may consider the nature, seriousness, frequency, and circumstances of the alleged infringements, together with any legal obligations that apply to us.
6. Other rights and remedies
Nothing in this policy limits any rights or remedies that may be available under applicable law.
Fluxer may preserve relevant information and cooperate with competent authorities, courts, or other lawful processes where required or permitted to do so.
